Right-of-Way Abandonment Pre-Application

This application serves to initiate the City's review of right-of-way abandonment requests. This initial step precedes the formal submission through the Chattanooga-Hamilton County Regional Planning Agency (RPA) Mandatory Referral Process. It's important to note that submitting this form does not commence the official process.

What Are The Requirements?

  • The pre-application deadline is set for every first Monday of the month, providing ample time for The Chattanooga Department of Transportation (CDOT) staff to review requests
  • It's important to submit pre-applications by the second Monday to ensure timely review
  • Any pre-applications received after this date will be considered for review in the following month

Some Conditions And Restrictions On This Application

Department of Public Works City Wide Services (CWS) does not maintain unopened rights-of-way and is not responsible for cleaning any abandoned/closed rights-of-way or one for which an abandonment request has been made.

New lot lines resulting from a right-of-way closure are determined through the title search and plat recording process. This process will be the responsibility of respective property owners to perform.

Applicants will be notified of CDOT's recommendation one week before the RPA's Mandatory Referral Process application deadline, scheduled for the fourth Monday of the month.

Process Details

Approval Process / Evaluation

  1. Submit the pre-application form above.
  2. Chattanooga Division of Transportation (CDOT) conducts an initial review.
  3. CDOT provides recommendations (Approval, Denial, Easement, Franchise Agreement, Temporary Use).
  4. Proceed with the Mandatory Referral Process.
  5. Present to the Planning Commission.
  6. CDOT informs the applicant of the conditions and the City Council's date—applicants are also encouraged to reach out to CDOT after the planning commission to check on approval status.
  7. The City Council makes the final decision (Approval or Denial).
  8. CDOT notifies the applicant of the outcome.

Processing Time

  • The duration of the review process for closure and abandonment is subject to variation depending on the location and complexity of the request. 
  • Typically, this process takes approximately 15 weeks in most cases.
