Storm Water Variance

A stormwater variance is required before any land disturbing activity may be performed within the 30 or 60 foot riparian stream buffer zones along both sides of any Waters of the State or wetlands.

What Are The Requirements?

Submit an application along with engineered drawings showing all proposed work, streams including top of bank and the 30 and 60 foot buffer zones measured from the top of bank. Include square footage of all disturbances within the buffer zones and whether the disturbance is temporary or permanent. Provide a completed water quality buffer tool showing disturbance and mitigation details. Provide a narrative detailing the need for disturbance in the buffer zone, hardships and other pertinent info to justify why a variance may be reviewed.
