What Happens After I Report a Code Violation?
Understand the procedures following the reporting of a code violation on:
Housing
- Notice of Violation: the property owner will receive a letter providing a 30-day window to address any concerns with the property.
- Re-inspection: after 30 days, another check will be conducted. If issues persist, the owner may be required to attend Environmental Court in about two to three weeks.
- Demolition Consideration: if the property requires demolition, a notice will be sent to the owner and posted on the property. Demolition hearings are scheduled every two months.
- Demolition Order: If the Hearing Officer decides on demolition, the property owner has 30 days to file an appeal in Chancery Court. If no appeal is made, the demolition process may take up to 60 days.
Abandoned or Inoperable Vehicles
Private Property
- Observation Period: we will monitor the vehicle for possible violations over a 10-day period.
- Notice of Violation: If the vehicle remains in violation, we will send the owner a Notice of Violation letter, instructing them to demonstrate operability or remove the vehicle within 10 days.
- Environmental Court Hearing: if the violation persists, we will cite the owner to appear at the next available Environmental Court hearing, usually in two to three weeks.
- Court Order: if the vehicle continues to be in violation, the City may request a court order for its removal.
Litter or Overgrowth
- Notice of Violation Period: we send a Notice of Violation letter to the property owner, providing a 10-day window to abate and bring the property into compliance.
- Re-inspection: after 10 days, we conduct a re-inspection. If the property remains in violation, we issue a citation to the owner, compelling their appearance at the next available Environmental Court hearing, usually in two to three weeks.
- Judicial Abatement: if the violation persists, a judge may order the City to abate. We send a Public Nuisance Notice to the property owner and post it on the property. Scheduling a contractor to abate the nuisance may take up to 30 days.
